Terms and Conditions

REGISTRATION

There is no official registration process; bids will be accepted by raising your hand in the air.


PROMOTER/SPONSORS

The promoter of the auction is the Canterbury Regional Council (known as 'Environment Canterbury') in conjunction with the Ministry for the Environment ("promoter"). The auction goods and services ("goods") are donated by Sponsors.


CURRENCY

All bids and purchases shall be made using Step Up Points — these will be provided prior to the auction to certain groups such as users of the Clean Heat Project and MetroCard holders, and are collectable onsite. New Zealand Dollars or other legal tender will not be accepted at auction and a shortfall in Step-Up Points can not be made up using legal tender. However, some items may be purchased directly from Sponsors' booths using legal tender — under the Terms and Conditions of trade specific to each Sponsor.


BIDDING & RESERVES

The highest bidder shall be the purchaser. In the event of a dispute, the Auctioneer’s decision will be final. There are no reserve prices — all items MUST be sold. Goods are not redeemable for cash or transferable.


PAYMENT & COLLECTION OF PRODUCT/SERVICE

Full payment in Step Up Points must be made immediately after the Auction. The winning bidder will be given a ‘Winners Card’ after the auction, which they must present to the Cashier along with the required amount of Step-Up Points. In return, the winner will be given a Bill of Sale for the goods which must be presented at the relevant Sponsor's booth to redeem the goods. Any delivery requirements must be arranged directly with the Sponsor (additional costs may be incurred). All goods shall be the sole risk of the winning bidder from the time of delivery to them by the Sponsor.


INSTALLATION COSTS

In the event that a product is auctioned which requires installation , the winning bidder shall be responsible for the installation costs and arrangements (unless otherwise specified as being part of the purchase prior to auction).


SERVICE VALUES

In the event that a service or installation is auctioned to a pre-set value, the winning bidder agrees that costs additional to the pre-set amount may be incurred, and charged by the Sponsor, depending upon the complexity and individual requirements to benefit from the service or installation, and such additional costs shall be the responsibility of the winning bidder. It shall be the winning bidder's responsibility to address such issues with the relevant Sponsor.


QUALITY/SUITABILITY OF GOODS

The promoter makes no representations about the quality, suitability or otherwise of the goods sold at auction. It does not warrant the accuracy of any fact, particulars or advertisement of the sale of goods, or any statement by the auctioneer, and does not warrant the suitability of the goods for any purpose whatsoever. The purchaser agrees that they purchase the goods in reliance upon their own judgement and not upon any representation or warranty made by the promoter or its agent, and shall make no claim in that respect.


FAILURE TO MEET TERMS & CONDITIONS

If the winning bidder does not meet these Terms and Conditions (including, but not limited to, failing to provide sufficient Step Up Points, on purchase), the Cashier reserves the right to declare the goods as unsold. All unsold goods will be returned to the lot for re-auction at the next opportunity.


EXCLUSIONS

Environment Canterbury Staff, Contractors and their families may not participate in the auctions.
